HC files notice of motion in rape and murder case

IMPHAL, October 4: The High Court of Manipur has today issued a notice of motion in respect of a writ petition filed by the mother of a young woman who was allegedly raped and murdered on the intervening night of January 29 and 30, 2010, said a press release of the Human Rights Law Network.
The said writ petition was filed seeking intervention of the High Court so as to provide the mother of the deceased, Rajkumar (o) Nganbi Devi the right of speedy and timely investigation and submission of charge sheet for initiation of prompt trial provided under Article 21 of the Constitution of India, it said.
The accused person in the rape and murder, namely Soibam Dhanabir Singh had admitted his involvement in crime by surrendering himself voluntarily before the then Director General of Police, Manipur and subsequent confessional statement given before the judicial magistrate, it said.
However, despite the incident occurring three years ago, the investigating agency has so far failed to file a charge-sheet for initiation of trial of the person involved in the crime and further said that owing to failure of the submission of charge sheet within stipulated period of time, the accused has already been released on bail, it said.
The writ petition had been filed to look into the lapses in the investigation on the part of the investigating agency, it said.
After hearing the submission of the counsel of the petitioner namely Sagolsem Shubharani, the Justice N Kotiswar Singh issued a notice of motion to the respondents.
The respondents in the writ petition are the State of Manipur through the Principal Secretary (Home), the Director General of Police, Manipur and Thokchom Vikramjit Singh, MPS, Sub-Divisional Police Officer, it said.
