Aggrieved AR personnel’s counsel serves notice against respondents to comply with court’s ruling

IMPHAL, September 23: Two years after the Gauhati High Court Imphal bench pronounced its judgement in favour of Naib Subedar Ramesh Chand Sharma, to allow him to enjoy his deserving benefits denied to him with regard to a service promotion that he was denied of the respondents of the particular case have failed to comply with the judgement till date.

Taking serious note of the failure, the counsel of Ramesh Chand Sharma has served a legal notice to the respondents including Union of India, through the Secretary, Ministry of Home Affairs, Government of India, New Delhi; the Director General, Assam Rifles Government of India, Shillong and commandant 30th Assam Rifles, on September 20 asking the respondents to comply with the court order within three weeks from the date of receipt of the legal notice so as to avoid further legal complications.

Ramesh Chand Sharma (53), son of Wadho Ram Sharma, a resident of Jindwin Village, PO Didwin, PS Bhota, Hamirpur, Himachal Pradesh, Naib subedar presently posted at the IGAR (S), had filed a case at the Gauhati High court, against the three mentioned respondents. Ramesh Chand Sharma was serving as a Havildar when he filed the case.

As per the legal notice, the counsel mentioned that his client was denied promotion to the rank of Naib Subedar, though he was due w.e.f December 1, 2004 and was superseded by his juniors. Dismayed over the injustice, Ramesh Chand Sharma filed a writ petition at the Kohima Bench, Gauhati High Court, in 2006, seeking justice by directing the authorities to promote him. The Court dismissed the writ petition with the observation that the same has no merit and the in view of the judgement Ramesh Chand was promoted to the rank of Naib Subedar with retrospective effect from December 1, 2004.

However, the authorities wrongly fixed the pay and allowances of Ramesh Chand, by giving one increment in total violation of rules. Ramesh Chand is reportedly entitled to get a total amount of Rs 6,53,575, after calculating the pay and allowances with effect from December 1, 2004 till date.

In the meantime, the counsel also mentioned that the authorities also denied his promotion to the post of subedar though he is entitled to the same w.e.f. February 1, 2011 and stated that he has been wrongly promoted observing that he has been actually serving as a Naib Subedar w.e.f. March, 12, 2012.

In view of the mental agony and physical torture to Ramesh Chand Sharma in addition to all the entitlements including promotion to the post of Subedar and arrears pay and allowances, it called upon the respondents (authorities) to pay a compensation of rupees Rs 20,00,000.
