HC serves show cause notice against RIMS unauthorised churches

IMPHAL, October 28: A division bench of the Manipur High Court, comprising of Chief Justice (Acting), Laxmi Kanta Mohapatra and justice N Kotishwar, has served a Show Cause notice returnable within two weeks to the respondents in the PIL case filed against construction of unauthorised religious structures inside the RIMS campus.

Dr Khomdon Singh Lisam, retd Project Director of Manipur Aids Control Society (MACS) had filed a Public Interest Litigation, on October 25, challenging the constitutional validity of the construction of particular religious institution to own and acquire immovable property located in the complex of RIMS, pleaded the court for giving direction to the authority respondent, the director of RIMS, for speedy eviction of unauthorised occupants encroached in the RIMS under the provisions of the Manipur Public Premises (Eviction of unauthorised occupants) Act, 1978.

The case was accepted by the bench and allotted (PIL) no 19 of 2013.

After hearing both the counsels, the division bench issued a show cause notice returnable within two weeks to the respondents.

During the hearing, sr advocate Th Manihar, appeared on behalf of the petitioner while advocate Nirmolchand appeared on behalf of RIMS.

It may be recalled that the petitioner filed the PIL against the State of Manipur represented by the Chief Secretary of Manipur, the Union of India represented by Union Health Secretary, Ministry of Health and Family Welfare, Government of India, Regional Institute of Medical Sciences (RIMS), Imphal represented by director of RIMS, Lamphelpat, the deputy director RIMS, commissioner (Revenue), Government of Manipur, Imphal West, deputy settlement officer (Admin)/AIPO, Government of Manipur, the survey and settlement officer, Directorate of settlement and Land Revenue, Government of Manipur and others.

In the PIL, the petitioner stated that there are three encroachers in the RIMS campus disturbing and blocking developments and violating the rights of the medical students.

Moreover, it further pointed out that the institute is having its layout plan for new development coming up in the near future. But, it is learnt that the land of RIMS campus is encroached by private individuals.
