Contempt of Court proceeding for parting for Chief Secy

IMPHAL, July 29: The Manipur High Court has today issued a notification to take up a contempt of Court proceeding against the outgoing state Chief Secretary for failure to comply with the Court’s May 17, 2013 order to implement the recommendation of the review DPC regarding the promotion of MCS II within two months, informed a source.

According to the source, six senior officers had been superseded by their juniors in the promotion from Junior MCS (Senior Grade) to MCS (Selection Grade) out of 14 MCS officers recommended by a DPC conducted on February 17, 2010.

The 14 were recommended from 20 eligible officers, informed the source.

Following the development, the senior officers had also filed a case with the Gauhati High Court in 2010 following which the court had set aside the February 17 DPC proceedings and had on April 4, 2012 Justice BD Agarwal while citing manipulation of ACRs had directed for fresh DPC within four months, informed the source.

The post of Jr MCS (SI Gr) has been abolished and re-designated as MCS Gr II in the year 2012, the source informed.

Exactly four months after the court order of April 4, 2012, a review/fresh DPC was held on August 4, 2012 and recommended 14 fresh officers in which four junior officers recommended by the first DPC were dropped and replaced by four senior officers on the basis of the ACRs, the source informed.

However, the government has failed to issue promotion orders inspite of the court orders but still allowed the four juniors officers not recommend by the review DPC, to work in the capacity of MCS-II, which is gross violation of the court’s orders, said the source.

In the meantime, the state government had initiated a new DPC for MCS-II in the year 2013, which the High Court of Manipur in W.P.(c) No. 2013 of 2013 had stopped and again directed the state govt for compliance of the recommendation of the review DPC on May 17, 2013 within2(two) months.

Accordingly, the Government of Manipur held the review DPC for promotion of Jr MCS (Sr Gr) to Jr MCS (SI Gr) as per direction of the Gauhati High Court, however, recommendation made by the said review DPC has not been implemented by the concerned department, the source informed.
